Federal Magistrate Judge in the U.S. Recommends Nullification of Jetaire Patents in Legal Battle with AerSale

AerSale Corporation (Nasdaq: ASLE) has received encouraging news in its legal dispute with Jetaire Aerospace, LLC, Jetaire Flight Systems, LLC (together known as “Jetaire”), and Michael Williams, the owner of Jetaire. A U.S. Federal Magistrate Judge has recommended a favorable outcome for AerSale in their lawsuit regarding AerSale’s AerSafe products. These products are designed to reduce the risk of fuel tank explosions in specific commercial aircraft, including various Boeing and Airbus models.

The legal battle initiated on December 17, 2020, when Jetaire Aerospace alleged patent infringement by AerSale’s AerSafe products, based on three patents held by Jetaire Aerospace (referred to as the “Jetaire Patents”). In response, AerSale countered with claims asserting that their products neither infringe upon Jetaire Patents nor should these patents be considered valid.

AerSale sought a judgment favoring them on these counterclaims, arguing for non-infringement and invalidity of Jetaire’s patents. The Chief Magistrate Judge overseeing the case issued a report and recommendation on April 17, 2024, suggesting that the District Court should invalidate Jetaire’s patents and rule in AerSale’s favor on these counterclaims. Should the District Court adopt this recommendation, it would render Jetaire’s patent claims irrelevant. The detailed report and recommendation are accessible through provided links.

Nicolas Finazzo, CEO of AerSale, expressed appreciation for the Magistrate Judge’s thorough report and recommendation, expressing hope that the District Court would uphold it, thereby resolving all claims against AerSale by Jetaire.

AerSafe® is a solution developed by AerSale to meet the FAA’s latest fuel quantity indication system (FQIS) and fuel tank flammability mitigation requirements (FTFR). The system involves precision-cut reticulated polyurethane foam blocks placed within an aircraft’s fuel tank, effectively reducing oxygen levels and mitigating ignition risks. AerSafe is designed for easy installation, with pre-packaged foam blocks that eliminate the need for on-site cutting or modifications, resulting in minimal downtime. Additionally, the system requires no additional maintenance between heavy checks, making it a preferred solution for ignition risk mitigation.

AerSafe is certified as a method of compliance (MOC) and meets regulatory requirements, offering peace of mind to aircraft operators.
