A U.S. Federal Magistrate Judge has recommended a favorable outcome for AerSale in their lawsuit regarding AerSale’s AerSafe products. These products are designed to reduce the risk of fuel tank explosions in specific commercial aircraft, including various Boeing and Airbus models.
The legal battle initiated on December 17, 2020, when Jetaire Aerospace alleged patent infringement by AerSale’s AerSafe products, based on three patents held by Jetaire Aerospace (referred to as the “Jetaire Patents”). In response, AerSale countered with claims asserting that their products neither infringe upon Jetaire Patents nor should these patents be considered valid.
AerSale sought a judgment favoring them on these counterclaims, arguing for non-infringement and invalidity of Jetaire’s patents. The Chief Magistrate Judge overseeing the case issued a report and recommendation on April 17, 2024, suggesting that the District Court should invalidate Jetaire’s patents and rule in AerSale’s favor on these counterclaims.
